The Board is requested to award a construction contract to MV Electric, LLC for the construction of the Influent Pump Station Back-Up Power Modification in the amount of $739,500, to authorize the County Manager to execute the contract, and to authorize the County Manager to execute any related contract amendments, not to exceed a total project budget of $813,450.

 

Background:

The Influent Pump Station Back-Up Power Modification includes two main components: (1) installation of an electrical interconnect between the influent pump station generator and the bio-solids building generator and (2) replacement of the variable frequency drives at the influent pump station. A ten percent contingency is recommend for this project to cover unexpected expenses.

 

Durham County issued an Invitation for Bid (IFB 18-001) on October 26, 2017. IFB 18-001 was advertised in local newspapers and on the Durham County website. On December 20, 2017, one bid was received and returned unopened as three bids are required for formal bid openings during the initial advertisement of a formal construction bid.

 

Durham County proceeded to issue a rebid (IFB 18-001R) due on February 15, 2018. Durham County received one bid from MV Electric, LLC. However, MV Electric LLC’s bid was deemed non-responsive as MV Electric, LLC is not a licensed General Contractor in the State of North Carolina but only a licensed Electrical Contractor in the State of North Carolina. The contract specifications had indicated only licensed General Contractors in the State of North Carolina may bid on the work.

 

Upon consultation with legal and the design engineers, it was determined the specifications could be revised to qualify both licensed General Contractors or Electrical Contractors as either could perform the proposed scope. As a result, the project was rebid a second time as IFB 18-001 Rebid 2 with revised specifications on March 8, 2018. Two bids were received on March 20, 2018. The lowest bid in the amount of $676,124 submitted by JL Britt Electric, Inc. was deemed non-responsive due to a lack of good faith efforts in meeting MWBE requirements. The next lowest bidder was MV Electric, LLC with a bid amount of $739,500. The bid tabulation and recommendation of award prepared by the design engineer firm is attached. The County Manager’s bid rejection for JL Britt Electric, Inc. is attached.

 

In review of the MWBE Compliance for IFB 18-001 Rebid2 Influent Pump Station Back-Up Power Modifications, MV Electric, LLC is an MWBE Certified Woman-Owned business and will be utilizing 6% MWBE Certified Black-American business and 5% MWBE Certified Woman-Owned business as subcontracting MWBE participation on this project. This project will have a total of 100% MWBE Certified participation.

 

Alignment with Strategic Plan: This action is in accordance with Durham County Strategic Plan Goal 4: “Environmental Stewardship and Community Prosperity,” as this project will ensure reliable operation of the Triangle Wastewater Treatment Plant.
